Special Drive for Deemed Conveyance

Conveyance of any Property is transferring the ownership Rights and Title of that Property from the Seller to the buyer. A Co- Operative Housing Society formed by Flat Purchasers/Owners under the provisions of Maharashtra Co- Operative Societies Act, 1960. Society becomes a buyer and Land Owner / Property Developer is seller. Conveyance is a process of transferring the rights, title and ownership of the land and building from the Land Owner / Property Developer to the Co-Operative Housing Society.

It is legally important that Society should get their Conveyance Deed registered and enter its name on the Government Revenue Records i.e. 7/12 extract or Property Card etc. It is a mandatory by Law and it avoids future litigations in the said property. It is also necessary to have clear and marketable Title of Property / Land before going for Redevelopment of the Property. Societies can retain additional F.S.I granted due to changes in DC Regulations

Deemed Conveyance required when developers/ land Owner or their legal heirs are not Co-operating or they are not traceable, housings Society appears before The Designated Competent Authority with required documents.  Authority conducts hearings of both the parties and passes the necessary order of Conveyance. It is a legal solution against the defaulter Developer/ Landowner.

More than 75% housing Societies are not having their Conveyance Deed, hence Government has taken lot of efforts to create awareness and amendments were to be carried out in the Maharashtra Ownership Flats Act, 1963 under the support of a Competent Authority to hear the grievances on Conveyance by the Societies or other legal bodies in 2005.

Government has taken special Drive to Speed up the process and create awareness of deemed conveyance from 1st to 15th Jan 2021, It is expected that maximum Societies should take advantage of this drive .

We have already supported hundreds of societies to get their conveyance deed. We are also taking maximum efforts to create awareness through social media, webinars and our helpline numbers.
